Do you have to register a will in India?
Registering a will is optional under Section 18 of the Registration Act, 1908. A will is valid if you sign it and two witnesses sign it as attesting witnesses, as required by the Indian Succession Act, 1925. Registration makes the will harder to challenge and keeps a safe record, but an unregistered will is not weaker in law. You can change or cancel a will any time; the latest valid will wins.
Why people still register
Registration at the Sub-Registrar’s office puts your identity and sound mind on record before an official, which helps if family members later dispute the will. You can also deposit a sealed will with the Registrar for safekeeping.
What makes a will strong
Clear names and relationships, a full list of assets, an executor, the date, and two independent witnesses. A short note from a doctor about your sound mind helps for older testators.
